    搬迁到澳大利亚的澳大利亚居民家庭的新签证安排


    在2024年对移民法规的最近修订中,澳大利亚政府对之前的1994年移民法规进行了几项显著的变更。最关键是修订极大地促进了授予Subclass 309(伴侣 - 暂时)签证以及Subclass 100(伴侣)签证。这两种签证适用于澳大利亚公民、永久居民以及符合条件的新西兰公民的伴侣,授予他们居住在澳大利亚的权利。

    In the recent amendment to migration regulations (2024), the Australian Government has made several notable changes to the previous migration regulations (1994). In particular, the recent amendment greatly promotes the granting of both Subclass 309 (Partner – Provisional) visas, as well as Subclass 100 (Partner) visas. These 2 visas apply to the partners of Australian citizens, permanent residents, as well as to partners of eligible New Zealand citizens, granting them the right to reside in Australia.


    When applying to reside in Australia as a partner of an Australian citizen, permanent resident, or New Zealand citizen, the provisional Subclass 309 (Partner) visa will first be granted. This allows you to reside in Australia before you receive the Subclass 100 (Partner) visa, which allows you to reside in Australia long-term.


    Who is a Partner?


    In the context of both visas, the partner does not just refer to the spouse but also extends to the person who is in a de facto relationship with the Australian citizen, permanent resident, or New Zealand citizen living in Australia. This arrangement recognises not just married couples, but also couples who are not married but have been living together – also known as de facto relationships.


    De facto relationships, where couples live and have a committed relationship with each other apart from marriage, are recognised under Australian Law. In the granting of partner visas, de facto couples are accorded the same access as married couples. However, there are specific considerations that Australian authorities may require to determine a de facto relationship. Consulting a migration specialist would be highly recommended for de facto relationships.


    Implications of the Amendment (2024)


    Under the previous migration regulations, there was an age limit placed on who would be classified as a member of a family unit. Family members who were over the age of 18 and had the means to support themselves were no longer covered under being a member of a family unit. This meant that to continue living and working in Australia, they would require visas.


    The recent amendment rectified this problem by allowing secondary applicants to be granted visas if they are dependents of a primary applicant for a partner visa. The primary applicants for partner visas would be the partners of Australian citizens, permanent residents, and New Zealand citizens residing in Australia, and the secondary applicants, charges who are dependent on the primary applicants regardless of age. This change enables family members of the non-Australian partner to be granted visas as well. Relocating to Australia has become much smoother administratively for family members – children and elderly.
